Terms and Conditions

1. GENERAL

The following general terms and conditions govern all contracts, delivery and miscellaneous services of GABLONZER Christbaumschmuck.
GABLONZER Christbaumschmuck reserves the right to adjust these terms and conditions at any time without specification of reasons. If single paragraphs become partly or as a whole impracticable, the residual regulation remains valid.

2. CONCLUSION OF CONTRACT

The product presentation in our Online Shop comprehends as a non-binding offer. By submitting an order the client places a binding offer for the conclusion of a sales contract. In return the purchaser receives an automatically generated response email which does not represent an official order acceptance yet. Only by delivery of goods or by confirmation through an additional email a valid sales contract comes into existence.
In case we realize during order preparation that the order is partly or as a whole not available anymore, we are going to inform you via email about it. If we already received a payment for unavailable goods we will reimburse the client with the same mode of payment used.
Orders can only be placed by persons who have turned at least 18 years.

3. PRICE

Our prices are quoted in Euro per piece, including all statutory taxes and exclusive all shipping costs.

4. PAYMENT

Methods of payment are cash on delivery (with COD fee), cash in advance, payment by credit card (MasterCard, Visa, American Express) and instant bank tranfser.
The payments with credit card and instant bank transfer are handled by the company Unzer. In case of cash in advance the total amount of the order has to be transferred in advance to our bank account, after the receipt of order confirmation.

5. DELIVERY & SHIPPING COSTS

The goods are dispatched with the forwarding company TPE (Tom’s Paket Express). Cash on delivery orders are sent via the Austrian Post (Österreichische Post AG). For delays in delivery that are caused by the freight forwarder, GABLONZER Christbaumschmuck is unable to take responsibility. Delivery is made within 3 working days after receipt of the order to the address indicated by the customer. In case of inaccurate, incomplete and/or unclear declarations made by the client, potential costs arising from these declarations will be borne by the clients himself/herself.

6. RIGHT OF WITHDRAWAL INFORMATION

6.1 Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you, acquires physical possession of the goods.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory. LINK

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

6.2 Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressively agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

7. RESERVATION OF PROPRIETARY RIGHTS

The delivered merchandise remains our belongings until the complete payment.

8. DATA PROTECTION

Customers agree that their personal data is electrically stored. Self-evidently, the data is used only for company’s purposes in private and confidential, and will not be forwarded to any third party.

9. COLOURS

Colour variations may occur between illustrated pictures on the website and the real products, depending on the colour reproduction of your monitor. GABLONZER Christbaumschmuck is not able to furnish a guarantee that the illustrated colours on the website are in accordance with real product colours. Because all products are made by hand slight deviations in shape, colour and decoration can not be ruled out. Hence, these deviations are no quality defects.

10. COPYRIGHT

All content of this website is copyright material and may not be used for any commercial purpose including copying, publishing, changing or gaining access to third parties. Any use without consent of GABLONZER Christbaumschmuck is strictly prohibited.

11. LIABILITY NOTE

In spite of accurate textual control we do not assume responsibility for the content of external links. For the content of these linked sites solely their operators take responsibility.

12. APPLICABLE LAW / PLACE OF JURISDICTION

The concluded contract is subject solely to Austrian law. Place of Jurisdiction is Steyr.
